About this draft
This is a working draft. It has not been legally reviewed and is not a contract. The prices and payment arrangements in the Prices and payment section reflect how we currently work. Text in [square brackets] marks a term we have not decided or confirmed. Where this draft and a signed proposal differ, the proposal applies once it is agreed.
Who we are, and who these terms are for
Nexstarc is the trading name of NEXSTARC TECHNOLOGIES, a registered partnership firm (Register of Firms number 2361/2026, GSTIN 32ABAFN1755C1ZU), based in Thiruvananthapuram, Kerala, India. Full details are on the Company Details page.
These terms are meant for both business clients and individuals. If you are an individual using our services for personal rather than business purposes, you keep the mandatory consumer rights that apply where you live, and nothing here removes them.
Our services and how projects start
We build and look after websites and stores, and offer related services such as integrations, search visibility, AI features and website care. We agree the scope, price and payment schedule before work begins. A project starts once the proposal or order is agreed [how agreement is recorded, for example written acceptance by email].
Prices and payment
| Offer | Price | How it works |
|---|---|---|
| Express website | €200 fixed | Up to 10 pages, built from a suitable premium template (including marketplace templates such as ThemeForest) or a complete client-supplied design. Both routes need straightforward design and functionality, and the project must meet the approved scope and eligibility conditions. More than 10 pages, or complex design or functionality at any page count, need a separate scoped quote. There are no undisclosed Nexstarc charges within the agreed scope. Paid template or plugin licences are third-party costs, disclosed and agreed with you before purchase, and are not part of the €200. |
| Hourly work | From €10 per hour | Billed after the work is done. Ongoing hourly work is normally billed monthly. |
| Monthly care | From €300 per month | An agreed scope of updates, fixes and small changes. Billed for the previous month, and normally payable by the 10th unless agreed otherwise. |
| Fixed-price projects above €500 | Quoted per project | 40% upfront, or at the agreed design-completion milestone, and 60% after completion. |
| Projects of €500 or less | Quoted per project | Payment terms are set out in the proposal. |
Express delivery
The 24-hour delivery applies only once we have confirmed that your project qualifies and have received the scope and everything needed: your template choice or design, content, assets and access. It does not apply to every project.
Included post-launch support
Every website and store we build includes two months of post-launch support for minor changes, fixes and routine updates within the agreed scope. The two months start at handover. After that, support continues only under an ongoing care agreement or hourly work. New features and larger additions are quoted separately. The included support is not unlimited, and it does not apply to standalone hourly tasks or to services other than the website or store we built.
Currency
We invoice in euros (EUR) and US dollars (USD). Each proposal confirms the currency and the amount that applies. A price in euros is not the same number in US dollars.
Payment methods
We accept payments off-site, by direct bank transfer, transfers from Revolut to our bank account, and PayPal. You do not need a Revolut account to work with us. Payment is arranged through invoices. This website has no online checkout or payment integration. [any PayPal fees and who bears them]
Tax
Our accountant has confirmed that we do not add tax to invoices for our European clients, and no tax surcharge is added to the €200 Express price. That is not a statement about every country. [invoice treatment for clients in India, to be settled in the launch accounting checklist]
Late payment
We do not charge late-payment penalties. The agreed payment schedule applies.
Changes to scope
Additional work is explained and priced first, and we carry it out only after you have approved it. [how a change request is made and recorded]
Your materials and approvals
You provide the content, designs, files and access we need, on time, and you are responsible for having the right to use them. We ask for your approval at agreed points. If responses or materials we need from you are delayed for more than a week, delivery may need to be rescheduled. That includes Express delivery, which starts only once everything needed has been received. [approval windows and what happens if no response is received]
Third-party costs
Some costs are paid to other companies and are not part of our development fee. Examples are domain names, hosting, premium templates, paid plugins and other third-party licences, Shopify plans and apps, Odoo licences, running costs from AI providers and advertising spend.
Required paid plugins and other third-party licences are disclosed to you in advance, and you pay for them. We agree them with you before anything is purchased. [how each licence cost is itemised on the proposal]
No guarantee of results
We work carefully, but we do not guarantee search rankings, citations by AI assistants, traffic, sales or other business results. We use AI inside our process, and our team stays responsible for the decisions, checks and ongoing support.
Ownership and licensing
Ownership of the custom deliverables we have agreed with you transfers to you after full payment. This is subject to the terms of any third-party licences. It does not cover third-party themes, plugins, fonts and other licensed components, which stay under their own licences.
[when access is handed over relative to payment, to be settled in legal review] [our right to reuse general know-how and tools]
Portfolio
Every project currently shown in our portfolio is shown with the client’s permission to publish it. A future project is shown only with its own permission. [how permission is recorded]
Confidentiality, NDAs and project agreements
When you ask for one, we prepare a project agreement or a non-disclosure agreement (NDA) tailored to the engagement. It records the agreed scope, payment terms, delivery timeline and working arrangements. We do not use one universal standard contract.
Cancellation
Our approach is to take responsibility when an issue is ours, and to agree a fair refund where that is appropriate. If you ask to cancel a project, we discuss it fairly according to the circumstances, the work already completed and what you and we agree. We look at the payments we have received and any agreed third-party costs, and tell you what is owed or what can be refunded. We do not set fixed notice periods, charges or refund percentages in these draft terms. [final cancellation mechanics, to be settled in legal review]
Refunds
Refunds are assessed on the facts under the approach above. We do not promise a full refund in every case, and we do not treat a delay in your responses or materials as an automatic loss of your refund rights. [refund conditions and timing, to be settled in legal review] Any refund rights you have under mandatory consumer law are not affected.
Termination
Ending an agreement, including ongoing hourly work and monthly care, is discussed fairly according to the circumstances, the work completed and what you and we agree. We do not set fixed notice periods or charges in these draft terms. [what happens to files, access and unpaid amounts on termination, to be settled in legal review]
Responsibility and liability
During delivery, we are responsible for our own work and for putting right issues that are ours. After handover, you are responsible for operating the site, subject to the included two months of post-launch support and to any ongoing care agreement we have made with you.
Nothing in these terms limits liability that cannot be limited by law. [the final liability clause, including any limits and exclusions, is for legal review]
Governing law and disputes
Our intended governing law is the law of India. [the court or place where disputes are heard, to be settled in legal review] Mandatory rights you have under the law of the country where you live are not affected where they apply.
Changes to these terms
[how changes are announced and when they apply] This draft was prepared on 8 October 2026.
